Your Interactions
Sowoff does not hold any responsibility for any sort of interaction made on the site. We do not screen any of our members for any reasons. Any personal information shared on the site should be done at their own risk. Under no circumstances will Sowoff be liable for any impact made on the member due to interaction with other users of the site.
Eligibility
By using the Sowoff service, you approve that
(i) the information submitted to the site is accurate;
(ii) you are 13 years of age or older; and
(iii) your use of the Sowoff services does not violate any Applicable Law. Your membership can be terminated if we believe that you have violated any of our policies.
Term and fees
The Agreement shall remain in effect while you use the Sowoff Services. You and Sowoff may terminate your Membership at any time. Being a member, you acknowledge that Sowoff reserves the right to charge for the Service and has the right to terminate a Member's Membership if Member should breach this Agreement or fail to pay for the Service, as required by this Agreement.
Password
You are entirely responsible for your password that you provide on the site. You should notify Sowoff immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account.
Non Commercial use by Members
The Sowoff is only for personal use and cannot be used for any direct commercial purposes. Illegal and/or unauthorized use of the Soroff, collecting usernames, user id numbers, and/or email addresses of Members by electronic or other means for the purpose of sending unsolicited email or unauthorized framing of or linking to the Sowoff Services, or employing third party promotional sites or software to promote profiles for money, is prohibited.
Proprietary Rights in Content on Sowoff
Sowoff owns and retains all proprietary rights in the Website and the Service. The Website contains copyrighted material, trademarks, and other proprietary information of Sowoff and its licensors. Except for that information which is in the public domain or for which you have been given written permission, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.
Content Posted
1. You understand and agree that Sowoff may review and delete any content, messages, Sowoff Messenger messages, photos or profiles (collectively, "Content") that in the sole judgment of Sowoff violate this Agreement or which may be offensive, illegal or violate the rights, harm, or threaten the safety of any Member.
2. You are solely responsible for the Content, material or information that you publish on the Service.
3. By posting any Content to the public areas of the Website, you hereby grant to Sowoff the non-exclusive, fully paid, worldwide license to use, publicly perform and display such Content on the Website. This license will terminate at the time you remove such Content from the Website.
4. The following is a partial list of the kind of Content that is illegal or prohibited on the Website. Sowoff reserves the right to investigate and take appropriate legal action in its sole discretion against anyone who violates this provision, including without limitation, removing the offending communication from the Service and terminating the membership of such violators.

Although Sowoff cannot monitor the conduct of its Members off the Website, it is also a violation of these rules to use any information obtained from the Service in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any Member without their prior explicit consent. In order to protect our Members from such advertising or solicitation, Sowoff reserves the right to restrict the number of emails which a Member may send to other Members in any 24-hour period to a number which Sowoff deems appropriate in its sole discretion.
i. is patently offensive and promotes racism, bigotry, hatred or physical harm of any kind against any group or individual; ii. harasses or advocates harassment of another person;
iii. involves the transmission of "junk mail", "chain letters," or unsolicited mass mailing or "spamming";
iv. promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
v. promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
vi. contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page);
vii. provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18;
viii. provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
ix. solicits passwords or personal identifying information for commercial or unlawful purposes from other users;
x. involves commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes.
5. You may not cover or obscure the banner advertisements on your personal profile page, or any Sowoff page via HTML/CSS or any other means.
6. Any automated use of the system, such as using scripts to add friends, is prohibited.
7. You may not attempt to impersonate another user or person who is not a member of Sowoff.
8. You may not use the account, username, or password of another Member at any time nor may you disclose your password to any third party or permit any third party to access your account.
9. You may not sell or otherwise transfer your profile.
Protecting Copyrights and Other Intellectual Property
Sowoff doesn't allow the post of any material that violates copyright, patent, trademark, trade secret or other proprietary rights. However, is any such activity is suspected, we suggest you contact us with necessary information like
Member Disputes
You are solely responsible for your interactions with other Sowoff members or parties with whom you interact through Sowoff Services. Sowoff will have no obligation in getting involved in any of these disputes.
Disclaimers
Sowoff holds no warranty on user content. Sowoff holds no responsibility for any damage, injury or loss cause by Sowoff user. Sowoff is not liable for any links to other websites posted by users are not investigated and not liable for content on those websites. Sowoff does not approve linked websites. Sowoff will not be responsible for any damages or techinical malfunction of any telephone or computer equipments. Sowoff shall not be responsible for any loss or damages, personal injury or death, resulting from the use of Sowoff services or events whether online or offline. Sowoff holds no responsibility for any error, interruption, deletion, defect, delay in operation, theft or destruction, communications line failure, unauthorized access to any member communication.
Limitation on Liability
TO THE EXTENT PERMITTED UNDER APPLICABLE LAWS, SOWOFF SHALL NOT BE LIABLE TO YOU, OR ANY THIRD PARTY, FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, LOST PROFITS ARISING FROM YOUR USE OF THE SERVICES, EVEN IF SOWOFF HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY ARISING OUT OF THIS STATEMENT WILL NOT EXCEED THE GREATER OF FIFTY DOLLARS ($50) OR THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS.
Indemnity
You agree to indemnify and hold Sowoff, its subsidiaries, affiliates, agents, and other partners harmless from any loss, liability, claim, or demand, including, but not limited to, reasonable attorney's fees, made by any third party due to or arising out of your use of the Services in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above.
Other
This Agreement is accepted upon your use of the Website and is further affirmed by you becoming a Member of the Service. This Agreement constitutes the entire agreement between you and Sowoff regarding the use of the Website and/or the Service. The failure of Sowoff to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision.
